Odessa Resident Successful in Defending Counterclaim from Oil & Gas Workers Association President
Wallace Dunn, an Odessa resident succeeded in having a counterclaim from Oil & Gas Workers Association (OGWA) founder and president Matt Coday dismissed earlier this month.
Coday’s counterclaim against Dunn was dismissed under the Texas Citizens Participation Act (TCPA). Dunn was awarded attorneys’ fees and costs as well in a significant blow to to Coday.
Dunn’s original lawsuit against Coday was triggered in part of what Dunn is alleging was retaliation when he brought up concerns surrounding OGWA including it’s membership numbers, finances, and issues with meetings.
According to the lawsuit, Dunn initially agreed to serve on OGWA’s board to help get people to join as members. But from day one, he says he encountered irregularities — including being “named” to the board by Coday without any formal meeting or vote.
Citing prior experience on nonprofit boards, Dunn pushed for formal meetings with recorded minutes, a clear organizational structure, and access to financial records — all of which he said were necessary to fulfill his fiduciary duties. He alleges that Coday resisted these efforts.
After Dunn resigned from OGWA, he claims Coday launched a public smear campaign targeting him through OGWA’s social media accounts, the local newspaper, and direct communications.
The Texan notes several scandals that surrounded Coday including founding a “United White Person’s College Fund” when he was a student at Texas Tech University in 2003.
This is interesting considering that, according to OGWA’s policy page, Congressman Wesley Hunt sits on their policy committee.
Current Revolt spoke with someone familiar with Congressman Hunt’s board activity who confirmed that the congressman was not on the board of OGWA.
