This idea that they're going to just pass laws and see what sticks is already a terrible problem at the federal level. There needs to be hefty penalties for lawmakers federal, state, and local who vote for laws that ultimately get struck down as unconstitutional. Otherwise, what's the downside for them? Standing for reelection doesn't seem to be enough incentive to not violate The Constitution.
